These General Terms and Conditions of Sale (hereinafter the "GTC"), together with the "Special Conditions of Use of the Customization Service", the "Data Protection Policy" and the "General Terms of Use of the Website" govern the website www.maison-chateau-laguiole.com (hereinafter the "Website"). The Website offers for sale wine accessories and cutlery marketed under the brands "LIGNE W", "Château LAGUIOLE®" and "Guy Vialis" (hereinafter the "Products").
The Products are sold directly on the Website by LIGNE W SARL, with a share capital of €10,000, registered with the Chambéry Trade and Companies Register under number 502 063 845 0015, intra-Community VAT number FR88502063845, with its registered office at 32 chemin des Hauts de Chamoux, 73000 Chambéry, France (hereinafter "Maison Château LAGUIOLE®").
These GTC are addressed exclusively to Customers, defined as adult natural persons, consumers or non-professional buyers with full legal capacity to contract and acquire the Products offered on the Website (hereinafter the "Customer(s)").
These GTC apply to any order for Products placed via the Website. They exclusively govern retail sales contracts for the Products.
The GTC, together with the order confirmation sent to the Customer, constitute the entirety of the contractual documents binding on the Parties, to the exclusion of any other document, prospectus, catalog, or photograph of the Products, which are for indicative purposes only.
By placing an order on the Website, the Customer expressly and unreservedly accepts these General Terms and Conditions of Sale in force on the date of the order. This acceptance is evidenced by ticking a checkbox provided for this purpose during the ordering process.
Maison Château LAGUIOLE® reserves the right to modify the GTC at any time. However, the GTC applicable to the order are those in force and accepted by the customer at the time of placing the order.
The Products offered for sale on the Website are presented with detailed descriptions allowing the Customer to know their essential characteristics before any order.
Maison Château LAGUIOLE® ensures that the presentation of its Products on the Website is as faithful as possible to reality. However, the photographs and graphics displayed are for indicative purposes only and cannot contractually bind Maison Château LAGUIOLE®, particularly in cases of color, shade, or grain variations due to the specificities of natural materials or the settings of the Customer's devices.
The Products offered are available subject to existing stock. In case of unavailability after order validation, Maison Château LAGUIOLE® undertakes to inform the Customer as soon as possible, and no later than within three (3) working days.
Sales made on the Website are exclusively reserved for non-professional individual customers, for personal use. Maison Château LAGUIOLE® reserves the right to refuse any order that would suggest professional use or resale activity.
Maison Château LAGUIOLE® reserves the right to modify the characteristics of Products at any time or to remove them from its catalog, without effect on orders already validated.
To place an order, the Customer must follow the online purchasing process:
1. Product selection: The Customer selects the desired Products and adds them to the virtual cart by clicking "Add to Cart".
2. Cart validation: The Customer validates the cart by clicking "Complete Purchase".
3. Identification: The Customer identifies themselves with their account, orders without an account, or creates a new account.
4. Delivery and billing address: The Customer confirms or modifies their addresses.
5. GTC validation and confirmation: The Customer reads and accepts the GTC by ticking the provided checkbox. This validation constitutes an electronic signature with the same value as a handwritten signature.
6. Secure payment: The Customer proceeds to payment via the secure interface.
Once payment is validated, the Customer receives an order confirmation email. The sale will only be final after Maison Château LAGUIOLE® sends an email expressly confirming acceptance of the order.
Once payment has been made, the Customer cannot modify the order. They remain free to exercise their right of withdrawal.
Maison Château LAGUIOLE® reserves the right to refuse or cancel any order in case of abnormal character, fraud, technical disruption, incorrect details, underage Customer, or reseller.
Product prices are those indicated on the Website at the time of order. They are indicated in Euros, all taxes included, excluding delivery costs. Prices may vary depending on the Customer's geographical location.
If your country's currency differs from the Euro, the amount will be converted according to the exchange rate applied by your bank on the transaction date.
Delivery costs are specified to the Customer before final order validation.
In case of a manifest error in a Product's price, Maison Château LAGUIOLE® will inform the Customer and offer the possibility to reconfirm the order at the correct price or cancel it.
Customers located outside the European Union may benefit from VAT exemption. Customs duties, local taxes, or other import charges may be required and are exclusively borne by the Customer.
Full payment must be made directly on the Website at the time of order. Payment can be made by credit card (Visa, Mastercard, American Express), PayPal, or other local payment methods offered on the Website.
The Customer guarantees that they are fully authorized to use the selected payment methods and that sufficient funds are available.
Transactions are processed by a secure payment platform complying with PCI DSS standards. Banking data is encrypted and transmitted confidentially.
Payment will be considered validated after confirmation of the payment agreement by the issuing organization. In case of refusal, the order will be automatically cancelled.
Maison Château LAGUIOLE® retains ownership of Products sold until full and effective payment of the price.
Products are delivered to the countries mentioned on the Website. Some destinations may not be covered due to local restrictions or delivery difficulties.
Delivery is considered made upon transfer of physical possession of the Products to the Customer. Shipping costs are calculated based on the transport mode and delivery country selected.
It is the Customer's responsibility to accurately provide all information necessary for proper delivery. In case of incorrect address, any returned package will be re-shipped at the Customer's expense.
Maison Château LAGUIOLE® undertakes to deliver within the timeframes indicated during the order. In the absence of delivery by the expected date, the Customer may cancel the order after formal notice has remained without effect within a reasonable period.
The Customer must verify the condition of the packaging and the integrity of the Products in the presence of the delivery person. In case of damage, written reservations must be noted on the delivery slip within two (2) working days.
The Customer has a period of fourteen (14) calendar days from receipt of the Product to exercise the right of withdrawal, without having to give reasons for the decision.
To exercise this right, the Customer must notify Maison Château LAGUIOLE® of their decision:
• Via their customer account, under "My Orders" then "Make a Return";
• By email to [email protected];
• By postal mail to: Maison Château LAGUIOLE®, 860 Chemin de l'Étang, 63550 Saint-Rémy-sur-Durolle, France.
The Product must be returned within fourteen (14) days of notification, in its original condition, complete, unopened, in its original packaging with all accessories.
Return shipping costs are borne by the Customer. In case of non-conformity, costs are borne by Maison Château LAGUIOLE®.
Maison Château LAGUIOLE® will refund all payments received, including standard delivery costs, within fourteen (14) days of the withdrawal notification, via the same payment method used.
The right of withdrawal does not apply to customized Products made to the Customer's specifications.
Products benefit from the following warranties:
Legal warranty of conformity (Articles L. 217-4 et seq. of the Consumer Code): The Customer has a period of two (2) years from delivery of the Product to take action. They may choose between repair or replacement. They are exempt from proving the defect of conformity during the twenty-four (24) months following delivery.
Legal warranty against hidden defects (Articles 1641 to 1649 of the Civil Code): The Customer may request cancellation of the sale or a reduction in the sale price.
Commercial warranty: Certain Products benefit from a commercial warranty mentioned on the Product page. For Privilege Member Program Products, online registration activates the warranty. The warranty covers repair or replacement of Products defective due to manufacturing fault.
Commercial warranty exclusions: the commercial warranty does not cover accessories, personalized elements (engravings), blades, natural wear, poor maintenance, inappropriate use, unauthorized modifications, or force majeure. These exclusions do not limit the legal warranties of conformity and against hidden defects.
Claims must be addressed via the Website's contact form or by postal mail to: Maison Château LAGUIOLE® After-Sales Service, 860 Chemin de l'Étang, 63550 Saint-Rémy-sur-Durolle, France.
Products sold remain the exclusive property of Maison Château LAGUIOLE® until full payment of their price.
The risks of loss or deterioration of Products are transferred to the Customer upon their delivery to the address indicated during the order.
Maison Château LAGUIOLE® cannot be held liable in case of:
• Non-compliance with obligations by the Customer;
• Inappropriate or non-compliant use of Products;
• Incorrect information provided by the Customer;
• Aesthetic rendering of a customized Product not meeting Customer expectations;
• Unavailability or out of stock;
• Non-compliance with the legislation of the delivery country.
Maison Château LAGUIOLE®'s liability shall in any event be limited to direct damages only.
Neither Party may be held liable for damages resulting from a case of force majeure, as defined in Article 1218 of the Civil Code.
Force majeure events include: natural events, epidemics, acts of public authorities, acts of war or terrorism, telecommunications or transport blockages, labor disputes.
Obligations are suspended for the entire duration of the event. If the impediment lasts more than thirty (30) days, either Party may terminate the order without compensation.
The Website and all its elements (texts, images, videos, logos, interfaces, designs, MCL Atelier 3D tool and its renderings) are the exclusive property of Maison Château LAGUIOLE® and are protected by intellectual property law.
Any unauthorized reproduction, representation, or exploitation is strictly prohibited and constitutes an act of infringement subject to civil and criminal penalties.
Maison Château LAGUIOLE® offers two customization services:
• Engraving Workshop: adding personalized elements (engravings, texts) to certain Products;
• 3D Workshop: advanced configuration with choice of shapes, materials, finishes.
The visual rendering displayed cannot constitute a perfectly faithful reproduction of the finished Product. Slight differences may appear. The Customer acknowledges and accepts these variations inherent to the artisanal nature of manufacturing.
The Customer agrees not to use generated renderings for purposes other than their order. Personalized Content submitted by the Customer must not infringe third-party rights or contain illegal elements. Maison Château LAGUIOLE® reserves the right to refuse any inappropriate customization.
Maison Château LAGUIOLE® collects and processes personal data in connection with order management, in accordance with GDPR and French data protection law.
The data collected is processed for the purpose of managing orders and commercial relationships. It is retained for the strictly necessary duration.
The Customer has the right to access, rectify, erase, port, limit processing, object, and define post-mortem directives. For more information, please consult our Data Protection Policy.
These GTC are governed by French law. In case of dispute, Maison Château LAGUIOLE® invites the Customer to contact Customer Service to find an amicable solution.
Failing amicable agreement, the Customer may submit the dispute to the consumer mediator CMAP (Paris Mediation and Arbitration Center), accessible at www.cmap.fr or at: CMAP Consumer Mediation Service, 39 avenue Franklin D. Roosevelt, 75008 Paris.
Failing amicable resolution, any dispute will be brought before the competent French courts.
For the interpretation of the GTC, the content of the clauses shall prevail over their titles.
If any provision is considered invalid, the other provisions shall retain their full force and effect.
Data stored in Maison Château LAGUIOLE®'s computer system is considered as evidence of communications, orders, and payments between the Parties. Order forms and invoices are archived on a reliable and durable medium.
